Terms of Use

These Terms of Use (“Terms”) govern access to and use of QHDC Maintenance Console (the “Service”) provided by C.D.W.S Pty Ltd (ABN 26 270 276 724) (“we”, “us”, or “our”). By accessing or using the Service, you agree to these Terms.

1. The Service

The Service is a business dashboard and operations platform. Features may include job management, inventory, customer and supplier records, reporting, and related tools. We may update, suspend, or discontinue features with reasonable notice where practicable.

2. Eligibility and accounts

You must be authorised by your organisation to use the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly at maintenance@qhdc.com.au if you suspect unauthorised access.

3. Acceptable use

You agree not to:

  • Use the Service unlawfully or in breach of these Terms
  • Attempt to gain unauthorised access to systems, data, or other users’ accounts
  • Interfere with or disrupt the Service, including through malware or excessive automated requests
  • Upload content that is unlawful, harmful, or infringes third-party rights
  • Reverse engineer or copy the Service except as permitted by law

4. Customer data

Data you or your organisation enter into the Service remains subject to your organisation’s policies and any separate agreement with us. You grant us a limited licence to host, process, and display that data solely to provide and support the Service. Our handling of personal information is described in our Privacy Policy.

5. Intellectual property

The Service, including software, design, logos, and documentation, is owned by C.D.W.S Pty Ltd or its licensors. Except for the limited right to use the Service as authorised, no intellectual property rights are transferred to you.

6. Availability and support

We aim to keep the Service available and reliable but do not guarantee uninterrupted or error-free operation. Scheduled maintenance and unforeseen outages may occur. Support enquiries can be directed to maintenance@qhdc.com.au or 07 5582 0000 .

7. Disclaimers

To the maximum extent permitted by law, the Service is provided on an “as is” and “as available” basis. We disclaim warranties that are not expressly stated in a written agreement with your organisation. Nothing in these Terms excludes rights that cannot be excluded under the Australian Consumer Law.

8. Limitation of liability

To the maximum extent permitted by law, C.D.W.S Pty Ltd is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or business opportunities arising from use of the Service. Our aggregate liability relating to the Service is limited as set out in any applicable commercial agreement, or otherwise to the fees paid for the Service in the twelve months before the claim.

9. Suspension and termination

We may suspend or terminate access if you breach these Terms, if required for security or legal reasons, or if your organisation’s access ends. Provisions that by nature should survive (including intellectual property, disclaimers, and liability limits) continue after termination.

10. Changes to these Terms

We may revise these Terms from time to time. The “Last updated” date will change when revisions are published. Continued use of the Service after changes take effect constitutes acceptance where permitted by law. Material changes may also be communicated through the Service or by email where appropriate.

11. Governing law

These Terms are governed by the laws of Queensland, Australia. Courts in that jurisdiction have non-exclusive jurisdiction over disputes, subject to any mandatory consumer protections.
